General terms and conditions ReSkin-XL

Article 1 – Definitions

In these terms and conditions the following terms shall have the following meanings:

  • Reflection period: the period within which the consumer can make use of his right of withdrawal;
  • Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with ReSkin-XL;
  • Day: calendar day;
  • Durable medium: any instrument – ​​including email – that enables the consumer or ReSkin-XL to store information addressed personally to him in a way accessible for future consultation;
  • Right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period;
  • Entrepreneur: ReSkin-XL;
  • Distance contract: an agreement concluded between ReSkin-XL and the consumer via an organised distance selling system;
  • Product: a movable item supplied by ReSkin-XL;

Article 3 – Applicability

  1. These general terms and conditions apply to every offer from ReSkin-XL and to every distance contract between ReSkin-XL and the consumer.
  2. Deviations from these conditions are only valid if agreed in writing.
  3. If specific product conditions apply in addition to these general terms and conditions, the most favourable provision always applies to the consumer.

Article 4 – The offer

  1. The offer contains a clear and complete description of the products offered.
  2. Images are a true representation of the products offered. Obvious errors do not bind ReSkin-XL.
  3. Each offer contains such information that it is clear to the consumer what rights and obligations are associated with acceptance.

Article 5 – The Agreement

  1. The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set therein.
  2. ReSkin-XL will confirm the agreement by email.
  3. ReSkin-XL reserves the right to refuse orders or impose additional conditions.

Article 6 – Right of withdrawal

  1. The consumer can cancel the agreement within 30 days after receipt of the product without giving any reason.
  2. During the cooling-off period, the consumer must handle the product and packaging with care.
  3. The product may only be unpacked or used to the extent necessary to assess whether the product is preserved.
  4. If the consumer exercises the right of withdrawal, the product must be returned unopened, unused and, if reasonably possible, in the original packaging .

Article 7 – Costs in case of revocation

  1. Return shipping costs are the responsibility of the consumer.
  2. ReSkin-XL will refund the amount paid by the consumer within 14 days after receipt and inspection of the return shipment via the original payment method.

Article 8 – Exercise of the right of withdrawal

  1. The consumer reports the revocation to ReSkin-XL within 30 days of receipt .
  2. After registration, the consumer will receive instructions for returns.
  3. Returns without prior notification may be refused.
  4. The consumer shall return the product no later than 14 days after notification of withdrawal .

Article 9 – Exclusion of the right of withdrawal

The right of withdrawal is excluded for:

  • sealed products which are not suitable for return for reasons of health protection or hygiene and of which the seal has been broken.

Article 10 – Compliance with the agreement and warranty

  1. ReSkin-XL guarantees that the products comply with the agreement and the product description, and are suitable for normal use.
  2. If a product does not comply with the agreement upon delivery, the consumer must report this within a reasonable time .
  3. ReSkin-XL will, in consultation with the consumer, ensure replacement of the product or refund of the purchase price.
  4. Damage caused by misuse, normal wear and tear, or failure to follow instructions is not covered by the warranty.

Article 11 – Prices

  1. All prices include VAT.
  2. Obvious pricing errors do not bind ReSkin-XL.

Article 12 – Delivery and execution

  1. Orders placed on working days before 4:00 PM will generally be shipped the same day.
  2. Delivery times are indicative and depend on postal and delivery services.
  3. If delivery is not possible within 30 days , the consumer has the right to cancel the agreement free of charge.

Article 13 – Payment

  1. Payment must be made in advance using the payment methods offered.
  2. Post-payment is not offered.
  3. When paying by bank deposit, the order will only be shipped after receipt of payment.
  4. If payment is not received within 14 calendar days , the order will be automatically cancelled.

Article 14 – Complaints procedure

  1. Complaints must be reported fully and clearly within a reasonable time after detection.
  2. ReSkin-XL aims to respond to complaints within 14 days .
  3. If a complaint requires a longer processing time, the consumer will be informed about this.

Article 15 – Disputes and applicable law

  1. Agreements between ReSkin-XL and the consumer are exclusively governed by Dutch law.
  2. Disputes will be submitted to the competent court.

Article 16 – Additional provisions

Additional or deviating provisions may not be to the detriment of the consumer and must be recorded in writing.
